Pay their invoices without questioning the charges or Precision General contracting will file a lawsuit. It took less than four weeks from the time I notified Ms Curry of billing errors and discrepancies to the date of the lawsuit filing (7/24).
Samantha Curry Operations Manager, does not display knowledge of Progress Payments per the Contractors State Licensing Board notice 22-14 November 2022 BPC sections 7159 and 7159.5
Ms Curry billed a 20% "Progress Payment for completed work". I asked for details and Ms. Curry's email response was it is a flat 20% and invoice details are "unnecessary and unwarranted". I disagreed and pressed for details. I am a retired Manager Accounts Payable with several years construction accounting experience. I received a list although without line item cost. He is one example of a discrepancy:
I have asked Ms Curry, Eric Martineau, Anthony Jensen, and PGC's lawyer The Ward Firm multiple times "Where was the Wall Footing listed on the invoice as part of the demolition?". To date 8/22 no response. My conclusion is Either:
PGC is billing for services not completed or
PGC will have to pay to reinstall the Foundation Supporting wall footing which should never be removed or demolished in the first place.
We should have gotten everything in writing (itemized tasks with cost per task) and have a lawyer review the contract before we sign it.
