Can a person open an HVAC business and operate under someone else’s license.
If they are doing this is it legal? Why would a customer even use that company if they do not have an owner holding a license.
Absolutely Not!
I as a licensed HVAC contractor I would never let someone else use my license to open there own business. If you want to be a self employed HVAC contractor put the time in and take the test!
I know in my area there are four companies this is happening at. The work is not to code, and the contractor that is letting them use his license is on the hook for the complaints brought against his license.
It gives the rest of us that are licensed and insured a great selling point!!
They can but these are the requirements. The qualifying agent (person with HVAC license) can qualify two or more HVAC companies. In order to qualify an additional business entity, they must present evidence to the Construction Industry Licensing Board of supervisory ability for each business. They will be required to appear at one of the board’s monthly meetings. If they intend to do business as a corporation, partnership, limited liability company, any business entity other than a sole proprietorship or when you operate as an individual, they must apply to be the “qualifying agent” of the business. The business name will appear on their license.
You can not use another person’s contractor’s license. You can form things like joint ventures but I would not call that using someone else’s license.
I wouldn’t recommend doing this due to the fact that you would be putting your license on the line for any issues that may arise.
