This question has been asked and a lot of contractors don’t even know the true answer… Here is the correct answer for the State of Pennsylvania: “ALL” contractors that have employees are required to maintain Workers Comp Insurance on all their employees! The only exemption is on themselves as an owner. If a contractors employee gets hurt on your property YOU are liable for their injuries! If a contractor says he uses sub-contractors for employees then ask for there General Liability Certificates as well BEFORE work starts.
Yes. State law requires that contractors that hire employees must maintain workers comp insurance for ALL of their employees. If a worker was to get injured on your project than the owner of the property would be liable. Any legitimate company will provide you a bond, General liability insurance and a workers comp policy. You can also ask the contractor to add you as additionally insured for further protection.

If the contractor is a California roofing contractor, it doesn’t matter whether he has any employees or not - he must have Workman’s Compensation and cannot file an exemption status as of 2011.

In Florida, yes. You can verify on state website. Contractor must have workers comp insurance or show an exemption if they do not have any direct employees.

In Minnesota, it is not required to have workman’s comp insurance if the contractor is an individual and has no employees. If they have any employees they will need to carry this type of insurance.
Of course. You do not want to be liable if something happens while working at your house. If contractor has workers comp, they are liable.

Yes contractors must have valid workers comp for any employees they have. They may claim themselves exempt but not anyone working for them. If they have subcontractors than each sub should have their own works comp policy as well which would cover them even under his exemption. If no one has workers comp and an incident occurs the liability falls to the homeowner no matter if they had exact knowledge of this or not. Also ask for a COI and WC certificate with you listed as additionally insured.
