Employees do not need to be licensed in the State of Florida as long as the contractor is licensed for the work they are employing individuals to perform. Further the contractor must carry all insurance to cover employees in terms of liability and workers comp.

All subcontractors however must have a least a business license/ business tax receipt (the name varies in different geographic areas) but are also exempt from having a contracting license as long as the contractor hiring them is licensed for the work the subcontractor has been hired to perform.

In the State of Florida if each employee were required to hold their state license in whichever trade they are being employed for there would be virtually no one to work in the construction field.

As a business owner, you must always validate the contractors or companies you hire to sub work. Our company holds several licenses in-house, which is beneficial to the effectiveness of managing projects and the efficiency of communication between trades. However, when we have a project that requires a subcontractor to complete a specific need, then the contractor must be licensed, bonded and insured. But, beyond those requirements, verify the intangibles such as integrity, timeliness, professionalism, etc., because a company can meet the requirements and still not produce the results expected. My employees are not required to be licensed. All of my employees are covered by Workers’ Compensations.

All sub-contractors used are required to be insured and bonded.

W-2 Employees do not need to be individually licensed, but they do need to be covered by legitimate workers compensation insurance. (workers comp exemption for an officer is not enough)

1099 Subcontractors DO need to be licensed, and insured with appropriate liability insurance and workers compensation insurance.

in order to pull a permit for a project, the necessary trades people must hold a valid license for that profession, along with workman’s comp & general liability.
