If a contractor has no worker's comp insurance and he has employees working at my house, am I responsible?

Am I responsible for paying for the injury? Like Hospital Bills?

As we are a litigious society, if someone gets hurt, their attorney will sue EVERYONE!

Make sure you check your contractor’s credentials BEFORE he starts work. If he has no insurance, that is a huge RED FLAG!

It probably also means he does not pay his employees thru the proper channels. He may not take out taxes, or pay them cash under the table.

As the homeowner, you must protect yourself, and only hired licensed and insured contractors!

I totally agree with the previous answers - a homeowner could be liable for work accidents that happen at his property. Make sure a contractor is licensed and bonded and has a workers comp policy. This is a reason a legit contractor is a bit more expensive than a non licensed contractor.

You are not responsible, generally the contractor you hired is always responsible for the employees they hire to work on your home. This will always be your strongest case is a legal battle as well, however if for any reason the contractor can not pay or were to suddenly vanish at the sign of being sued (as some do) the employee may turn their lawyers toward you to pay.

Its always best to ask to see their license and proof of insurance’s so you can avoid anything like this, and always consider that a good professional will show you these things.

Worker’s Comp, Liability Insurance, Licenses and Registrations. All important to a safe project, and a good outcome. Why work with any company that does not have these documents proving their commitment to your project? If any of these elements are missing prior to the contract, the property owner is open for consequences they may never have realized they have opened themselves up to.
