If your state follows the International Building Code, you should consult Section 2406 Safety Glazing to identify all locations that require tempered glass. It is not only based on height above finished floor. You need to be concerned with windows adjacent to doorways, and above window seats if your local inspector considers a window seat a walking surface. Size of unit also matters. Any window within 18 inches of the floor requires Tempered glass. Also any window within 2 feet of a door requires Tempered glass. Check your local building codes for other Tempered requirements such as bathroom windows.

Windows must include safety glass if the bottom edge is less than 18 inches above the floor.
They must also include safety glass if the top edge is more than 36 inches above the floor, there is a walking surface within 36 inches of the glass, and/or they measure larger than 9 feet square.
If all 4 of these are true, then tempered glass is required.
The minimum height for the bottom of a window before you have to install temper glass is 18 inches
