Build a garage, attached to home

On 9-12-22, I signed a second contract with Mike Maringola, owner of All In One Contracting of around Rogersville, MO., and gave him a $10,000 deposit to build a garage attached to our home. As of this date (5-17-23) we are starting into the 9th MONTH of waiting for Mike to start this project!!! Granted, Missouri weather is always a factor...but he has had ALL THESE MONTHS to work in this job!! We have had continual delays, excuses, NO SHOWS, MANY UNRETURNED CALLS or E-MAILS, broken promises that we were "NEXT on the list", etc., etc.!!!

He sub-contracted with what turned out to be an INCOMPETENT gentleman to do the initial work (*trenching, footing, stem wall, pad, and concrete work)...none of which is done!!! Sub-contractor had 11 huge trucks of rock brought in (no prep work* done, yet), packed this MESS and, without my knowledge, had called in 2 HUGE concrete trucks to dump on top of THIS MESS!!! I had to run out and stop them, at the last second...then called Mike for the second time to report that this guy didn't know what he was doing!! Then, another sub-contractor was called in...who also DID NOT FINISH straightening out the problem...but dozed around the perimeter and dumped all the rock where the pad would eventually be!!! It now looks like the SWISS ALPS on the North end of our home, and THAT is how it is left for us!!!!

I informed Mike well in advance (by REPEATED phone and E-mail messages) that the workers could come out on Mon., 5-15- or Wed., 5-17-23 (and thereafter) to complete the foundation; but that NO work could be done Tues., 5-17-23, because I had a long-standing Dr's appointment that could NOT be cancelled!!! He ignored me and defied me, having the trencher delivered here to be used on Tues. ONLY...and sent an E-mail AFTER 10:00 P.M. the night before, advising me of this!!! I had to leave ANOTHER message that this COULD NOT be done Tues.; then, while we were part-way on the 95-mile trip (one-way) to the Dr's office, he FINALLY called to say he was on his way, and the workers were also driving out to start the work!!!!! I told him "NO!!! Turn around and call the others to NOT come, because NO WORK was to be done while I was gone!!!" We had a VERY UNFRIENDLY DISCUSSION about this, and he just QUIT...saying he would give me my money back, LESS the cost of 11 trucks of rock...and maybe something else (?). There have been NO MORE calls or E-mails, and I have filed a formal complaint against this company, as well as followed up with some other options!!!

Now, I can't move forward without my $10,000; this is the BUSIEST time for construction companies and I have to START FROM SCRATCH; I want a COPY of the ORIGINAL contract I signed (my yellow copy is faint and won't copy well); he has my original plans for the garage; and I would like a copy of his materials list for the project; we have lost going on 9 MONTHS of time; I am 79 and my husband is 81; we both have great difficulty getting around, and REALLY NEED this garage!!!!!!! To me, this is BREACH OF CONTRACT on HIS part, and puts UNDUE HARDSHIP on us, as senior citizens!!! We did ABSOLUTELY NOTHING to deserve this kind of treatment; we were GOOD CUSTOMERS; and we had NO DIFFERENCES before he started treating us this way!!!! It was totally unexpected, but I let him know that I WOULD NOT TOLERATE this treatment!!! Now, I want to warn others who are looking for a contractor to be mindful of what he did to us...BEFORE they consider hiring him!!!! This will be reported wherever I can, because everyone, especially senior citizens, has to watch out for the BAD APPLES who "spoil the barrel" for everyone!!!!! Pass this on, if it will help another family!!!!! Thank you!!!!!!!!
