Alvia A/C and Heating were dispatched out to my property from my home warranty company. The concern I had was no power to the unit, for as long as it took for their contractors to come out. We were able to determine that the fuse to the breaker on the air handler was not making proper contact, we pushed it back in and the unit turned on. I should have cancelled the call but due to this property be new to us (one month old) we decided to continue and still have it checked out by a professional.
When Mr. Mario A. Avila, finally showed after multiple attempts of setting up a date and time, he proceeded to due the normal inspection. This is a rental property, so my tenants were there, and they made me aware that he showed up. I called Mr. Avila to see what the outcome was, he mentioned the Evaporator coil had small leak and the compressor was amping up to high. He never mentioned that the unit was working seeing how he was to investigate that first, that is why he was called out. My A/C was working just fine at the time.
Mr. Avila proceeded to let me know that the warranty company would not cover these items and if he called it in, they would deny the claim, due to pre-existing conditions. I felt that Mr. Avila held this leverage against me, seeing how I was unaware of any conditions due to a new purchase on the property. Mr. Avila then starts informing me that if I purchased a new Air Handler at $2,706.25 the warranty company would cover the cost due to it being an upgrade, I asked Mr. Avila doesn’t the home warranty company require pre-authorization and he said “NO”.
It was explained to Mr. Avila that I did not have the funds to replace everything and only approved the air handler. Mr. Avila mentioned that he had a better system for me to purchase a 5T Carrier Air Handler that he had from other job, where the customer cancelled their install. I asked Mr. Avila would that work with the original equipment that I had? Mr. Avila tells me YES, he stated all these great benefits” very efficient” and work perfectly, having variable speed very nice and quiet. Having this unit installed that only he was aware of, seeing how I am not a HAVC professional. So, I only approved Mr. Avila to replace the Air handler based off his recommendations, paid Mr. Avila in good faith on Thursday December 15, 2022. During the install process Mr. Avila asked if I wanted to have an air purification seeing how my tenants will have a new baby in the house, I said no. Next Mr. Avila was running around town trying to cash my check, called me up and mentioned that these check cashing places would not accept my check because they could not verify fund due to my bank not answering the call. Mr. Avila asked me if I could call them and get them on the phone, I said no. Asked why he was out trying to cash my check, instead of working on the project. I ask Mr. Avila if something was going on, did he not have money or was having money trouble? He mentioned another story that his account was locked up with Carrier and working on trying to resolve his charge account. Mr. Avila made it to my bank and cashed the check, I felt something is just not right about this.
When I arrived later that evening 6:24 pm, I found the unit was not in working order. Mr. Avila was missing the Heat kit, Mr. Avila says to my tenant and I that he would return on Friday December 16, 2022, at 9:00am to install it. Never heard from him until the end of the day after several attempts to get an answer, I also wrote to Mr. Avila to return my original equipment and cancel the job at 4:03 pm. At this point I wasn’t even sure he would be returning; he cashed my check and took the money. Why was he having to install a new part, seems it was missing. What type of equipment was he really installing. After the installation, I found that my trim around my attic door had been removed and damaged with being screwed back in after they got the equipment pulled up, also damage to my wall, were the unit hit. Mr. Avila had me sign off on the invoice after the system was installed, after signing I noticed that he fraudulently noted a false statement, claiming that I was the one who requested this unit, after reviewing this I told Mr. Avila that I did not request this product seeing how I didn’t even know about it. He immediately left(ran) from the property and would not make any further contact with me in person.
After using this product 2 or 3 days, I found out that this 5T Air Handler was not working properly, there was no cooled air blowing. I reached back out to Mr. Avila to see why this was not working, he now brings to my attention that the 5T Air handler that was installed by him (based on his recommendation the professional) will not work with my 3T condenser and will need to purchase a 5T condenser. I asked Mr. Avila why you would give me inaccurate information, sell me a unit that was not compatible with my existing unit, Mr. Avila you mentioned several times before installing that
