In 2010 we hired Cherry Bomb Electric, Inc. for a large project renovating our commercial storage facility. We dealt directly with its President, Linwood (Woody) Cherry, III. We were happy with him at first, but eventually he asked us for payments which our general contractor was not willing to sign off on before Cherry Bomb Electric, Inc. finished a punch list correcting and completing certain items. Instead of correcting or completing those items as would be expected from a professional, Linwood (Woody) Cherry, III blew up, threatened to rip out his work and was eventually fired. He refused to even look at the items on our general contractor's punch list.
Thereafter, he filed liens against our property which we believe were intentionally exaggerated. We believe that he exaggerated these liens intentionally because he wanted to hurt us personally and professionally. We tried to negotiate in good faith but instead Cherry Bomb Electric, Inc. hired lawyers to sue us. Now, 6 years later we are still in the courts. This has been a terrible experience. The judge has already held that some of Cherry Bomb Electric’s liens were willfully exaggerated or so carelessly compiled as to be fraudulent pursuant to the Florida Mechanics Lien Law.
Sadly, even though the judge has held that Cherry Bomb Electric, Inc. filed fraudulent liens we are still stuck litigating this matter. In our opinion if Cherry Bomb Electric, Inc. had simply been reasonable enough and professional enough to negotiate in good faith and charge us accurately for the work that he had actually completed none of this would have happened. Cherry Bomb Electric, Inc. has literally cost us hundreds of thousands of dollars trapped in this litigation over the last 6 years.
