We contracted with City Fence for purchase and installation of a 60-foot long, 4-foot high, white vinyl, chain link fence. We paid fourteen hundred dollars ($1400.00) as per contract. The fence was installed on 8 August 2007.
The fence looked fine for a year; however, rust began to appear at some joints. Now, 4 years later, the “galvanized” steel is rusting at all the joints of the fence-frame and at the hundreds of the fabric ends. (It looked as if the fence links had been cut down to fit a 4-foot height. That cut destroyed the vinyl at the cut ends and exposed unprotected steel.) The company offered us a can of paint. Sarah, the company’s representative, said that its supplier does not guarantee the material, and, therefore, it does not guarantee the material. That explanation seems inconsistent with the company’s stated goals. So, it seems, our $1400 bought a can of regular, white paint.
A side issue was the 10-foot distance between line posts. But the representative said that distance is the norm unless the customer specifies the 8-foot span. Of course, the initial sales representative never explained that nor did we ask. Who knew to ask?
We managed to have a representative of the company inspect the fence. He said that he would never buy a white fence, that the white fence is cheap, and that it will always rust. But he saw no problem in selling an inferior product to us. He did tie, in two places, the fence-links to the upper support bar where we used plastic ties after we found there were no ties at all.
We almost decided to write off the problems with the fence since, we thought, we didn’t exercise “due diligence” in purchasing the product, in examining the company more thoroughly, and waiting this long. But we decided we couldn’t let the inferior product remain hidden. Besides. The guarantee was for 5 years. Chain link fences should last more than 4-years.
Obviously, we were duped by the company’s web site: 1) “City Fence is now in it’s 30th year of providing Western New York with the finest quality of material and workmanship available”; 2) “Our goal of providing the highest quality of service, material and workmanship means that we will be there when you need us, before, during and after your job is complete. We stand behind our material and workmanship with one of the finest warranties in the region.”
