I hired Mr. Juan Davila because I was impressed with the exterior work he & his crew had completed on the house next door. In early fall of 2018, therefore, I approached him about my exterior home project: Installation of (a) aluminum coil trim around windows & fascia, (b) aluminum soffit panels, (c) new gutter system including gutter guard [forest green color]; + (d) replace rotted wood. He presented his business card, informed me he had 20+ years experience and assured me he would do as professional a job, as he had done on my neighbor’s house. I signed a contract on 4 September 2018 and wrote a personal check for $4000 to ‘Davila Construction LLC’, half of the total cost of the job. He commenced work on the project in late October of 2018. The "swindle" [aided by a brutal winter] continued through July/August of 2019.
It was in February of 2019 that I learned Mr. Davila had misrepresented himself: He had not contracted with my neighbors to work on their house. It turned out that Mr. Davila was an employee of a professional siding company well known in the Twin Cities area. My neighbors hired the company because of its reputation for doing excellent work; and in line with that good reputation, the company routinely sent their foreman to the jobsite to inspect the project for quality control. Unfortunately for me, a ‘company sign’ with contact information was not on the worksite. Had such a sign been on display I am certain I would have avoided the rip off. This information was brought to my attention after the following events had transpired.
Deceptive practices and damages:
• Instead of a new gutter system, Mr. Davila jerry rigged pieces of my old gutter system with odd pieces of gutter/downspouts materials (white in color) likely salvage from random jobsites, and then painted these “recycled parts” forest green to conceal the fraud. However, because of the sub zero temperatures experienced last winter the paint began to peel. My immediate neighbors as well as residents who passed by my corner lot noted the deception and made me aware of it. I was furious and insisted adamantly that he hire a professional gutter company to do the job, which he did. In February 2019, after the installation of the new gutter system and after Mr. Davila’s contrite declaration that he had completed all the work, I gave him the final check payment.
• With the coming spring and improved weather conditions, I was able to carefully inspect the “finished project”. In doing so, I noticed two things: No gutter guard had been installed as per contract agreement; also, I noted that instead of providing proper aluminum soffit panels [as was done on the adjacent house project]; again, Mr. Davila in “a make do jackleg fashion” substituted left over aluminum trim coil materials for that purpose. I stayed on him until eventually, around August 2019, he brought in a young man - (a relative or a day laborer (?) who spoke no English and who clearly did not know what he was doing) - who ripped out the aluminum trim coil and install the soffit panels. The act of tearing out the trim coil extensively damaged the existing fascia around the dormers: the damage was not repaired and Mr. Davila refused to return my calls.
A real estate agent informed me that I must seek restitution because the above impairments reduced the value of my property. Furthermore, he explained that should the roofline incur future damage due to a natural event (such as a hail storm) no insurance company would approve my claim given the existing damages caused by Davila Construction LLC’s careless indifference. Aesthetically, the slipshod work, visible to all who pass by as the house sits on a corner, signifies not only the owner’s inattention to upkeep but also affects my home’s resale value.
The total lack of concern with regard to professional standards when engaged on my house project compared to the diligent, seemingly high quality work Mr. Davila completed on the adjacent property; makes plain that his intention from the outset was financial fraud. Furthermore, that I am a senior and a woman, and have a visual impairment to boot, suggests the cynical calculation was that I was an “easy mark”. Men like Juan Davila when caught should be accountable for their sharp practices. I seek the following amount in restitution.
