    The work is not complete and Everett has disregarded two emails & my phone call.

    First & foremost. References that contractors provide future customers are somewhat worthless. When applying for a job, would you provide a reference of whom your work was sub-standard? The answer is no! Well I am a current customer of Everett the President/owner of Decomar Construction Services Inc. What matters to me is the work you are performing for me and not what you are doing or have done for Mrs. Smith! I will provide pictures of the current work performed by Decomar Construction Services Inc. I have detailed information if you desire further elaboration.

    First, I provide a drawing packet to Everett the President/owner of Decomar Construction Services Inc. on multiple occasions via email and hard copy. When Everett arrived on 15 March, he did not have the drawing packet with him. My wife allowed Everett to use our copy but stated to Everett, at my direction that he need to bring the copy I provided him on multiple occasions via email and hard copy so he could do the work properly.

    We iterated to Everett that we would like to be kept informed of what work was being done and when the work would be completed. I specifically in a text dated 12 Feb 17 (before contract signing that I would track his schedule in Microsoft Project). We did not hide the fact that we wanted a schedule to track his progression. Everett stated to me that in construction they do not use Microsoft Project to track their work. I told Everett that I would track his progress and I would not require him to use Microsoft Project.

    Once the estimate was provided in January, I noted that Everett did not have the following items listed on the estimate:

    1. The exhaust fan for the stove.
    2. Relocation of the CD Intercom system from the wall that was to be demoed to a wall in the family room
    3. Moving theater speaker wire from one wall to another because we were relocating the TV.
    4. Early 10 Jan 17 Everett stated, he would get us in contact with a counter top guy that he has worked with which could save us money and Everett stated the guys he recommended did good work.
    o My wife got the information of the counter top guy 16 Feb 17, made an appointment to stop by the shop to speak with the owner and see the granite only to find the owner to not have an established showroom due to multiple reasons.
    5. Early Jan 17 Everett stated, he would provide his sound guy info
    o I emailed Everett on 6 Feb 17 and asked for the sound guy’s contact info again so we could discuss the moving of the intercom CD and theater speaker wire.
    o I spoke with again a week or so later. Everett explained to me that he did not want to provide the sound guy’s info because he did not want him to commit to work when we had not signed a contract. I emphasized that talking with the sound guy to see if he could do the work would not commit him to do the work. I further stated that Everett provided the information (name/phone number) of the counter top guy so I did not see why he could not provide the info on the sound guy. On 24 Feb when we signed the contract, I asked Everett for the info on the sound guy and Everett stated, “I do not have a sound guy.” I was disappointed because I was deceived by Everett!! I asked Everett, “Why did you tell me you had a sound guy several times and now you are telling me that you do not have a sound guy?” Everett stumbled his way through the answer, which was no answer.

    6. Non-working areas of our house were supposed to be protected from the dust (family room and living room), were completed fill with drywall dust. The demo area was not shielded with a curtain as promised when we spoke with Everett prior to signing the contract and again contract signing.
    7. A multitude of items were addressed with Everett on discovery March 2017. One significant item was the glue and adhesive that remained on the wood flooring after partial installation around 16-17 March 2017. The stained flooring was identified numerous times by myself and my wife and became a point of contention the last week of 23 March 2017 when my wife stated she had reached her level of compromise because we were living in a dust filled home with glue everywhere. Everett stated, his crew probably tracked the glue/adhesive in their getting around (hence, they did not clean as they worked & also, Everett did not take precaution to cover the floors as they worked). Everett agreed to have someone clean up the adhesive/glue and stated the cleaning crew come in 29 March 2017. The cleaning crew did not come to the house on 29 March. I did not receive a call from Everett stating the cleaning crew were not going to come. A worker did come to the house and worked diligently to remove the adhesive but he could not remove the adhesive. I notified Everett on 4 April 2017 that the cleaning crew had not been to the house to clean as Everett stated. Everett further stated it was just glue on the wood floors and that it would come up in the end. Everett also stated, he thought it was best for us to wait until the end of the project and he would have a cleaning crew do their work at that time.

    We were consistent in pointing out items that were broken or had poor workmanship. Around the end of March, I created a listing of items that needed to be reworked. Everett got frustrated and stated that I created a punch-list and in construction, they wait until the end of the project and correct everything. Everett consistently mentioned that we should call his references to understand how he works and that he is very meticulous in his work and that he didn’t need anyone to go behind him to correct work. Everett further stated that everything would get corrected at the end and that we needed to trust him and allow him to do his work. His specific words were, “he wanted to do a good job for me just let him work.”

    Everett stated to myself and my wife that we did not understand construction as they do not clean as they work. Construction workers wait until the end of the project then they clean and touch up. In construction we broom sweep the area at the end of the day.

    8. During the March time frame, Everett became angry with my wife one day. Situation: my wife needed to leave the house. She went to our son who was in the room and told him that she was leaving and that he needed to make himself visible while she was gone. Everett took offense to that and told my wife, “that he had never been treated so poorly by a customer…. but maybe just one other time I was treated badly.” Everett stated, other customers provided keys to their house along with the security code to the alarm system. Everett further stated that we had cameras in our house looking at them.
    o Not sure why Everett was upset that my wife does not trust him and his contractors. We’ve had cameras for years and so what if we do not trust him or his crew. We do not personally know any of them.

    9. Below is an email I sent to the buildzoom.com representative who oversees the construction project. Everett charged us an additional $225 to install an electrical outlet on the island. In Everett’s estimate, we were charge for electrical outlets to be installed by code….Florida code. So essentially, Everett charged us twice for an electrical outlet on the island. FL code states:
    E3901.4.2 Island countertop spaces.
    At least one receptacle outlet shall be installed at each island countertop space with a long dimension of 24 inches (610 mm) or greater and a short dimension of 12 inches (305 mm) or greater.

    10. As I mentioned above in item number 7, Everett told us to trust him and allow him to do his job. Look at the conversation below. Everett stated to my wife that the granite backsplash could be installed around the light-rail which is installed on our cabinets. That information was not correct and the cabinets were so badly leveled, that the countertop guy refused to measure for the granite template.

    o Everett would not take responsibility for the cabinets not being leveled. He blamed the manufacturer of the cabinets stating the individual were not constructed the same. My opinion is cabinets are not all constructed at the same height which is why you hire an installer (Decomar Construction Services, Inc.) to install and level the cabinets. We had to get back on the schedule of the fabricator which took a week. The fabricator came out a week later with Everett being present and the cabinets were still not leveled. The fabricator instructed Everett again on what he needed to be completed prior to the granite installation. Everett took note again of what need to be accomplished and stated that he would be present when the countertops arrived for install on 28 April 17. Needles to say, this caused a 3week delay in the install and Everett did not show up for the install as promised.
    - My cabinets are at least 5ft in length inany direction when placed together. The fabricator aske me to have Everett show me how he determines that the cabinets are leveled. The fabricator showed me how the leveling should be measured. I asked the fabricator, what was the length of his leveler and he stated 6ft. I went and purchased a 6ft leveler from Home Depot. Everett used a 2ft leveler and only measured a single cabinet at a time instead of using a leveler which spread across the entire section in order to see if the attached cabinets are leveled. I told Everett what the fabricator said about how the measurement should occur and I pulled out my 6ft leveler. Everett had a surprised look on his face when I placed the leveler across all the cabinets which showed the gap and high ridge in the cabinets. Everett immediately went on the defense and stated that he can not be responsible if each cabinet is not the same height and that it is the fault of the manufacturer. Everett further stated that he and the fabricator should be talking and he asked for the fabricator’s phone number.

    11. Around the end of March, the air conditioner (AC) stopped working because of all the dust from the demo clogged the system. The AC stopped working on a Saturday and we notified Everett on Monday. The AC guy came out and noted the system stopped working because of the dust from the demo. The AC guy asked if the vent was covered during that time (which is was not). The AC guy cleaned the system and we were back up and running. The dust was so bad in the house that the fire alarm system repeatedly sounded which alerted the company that monitors our system. Everett eventually covered the fire alarm to stop it from sounding.

    12. Over the time of our project, Everett had a difficult time communicating with us on the status of the project and any changes, e.g., his contractors were scheduled for work at our location and no one showed up. When workers were scheduled to be here and did not show, I did not receive a call from Everett notifying us that his workers would not be available. This occurred a few occasions that will be documented below. Everett was upset at my wife because she asking for updates (this should not be a surprise as I told Everett, I wanted to track his progress in Microsoft Project and as his customer who is paying him, we should be updated on the work he is doing). I guess as a punishment to us for asking for updates on our project, Everett refused, yes I said refused to conduct further work on site until after the counter tops were installed because he was upset and felt that is was best for him not to be at our house working. The counters were installed 28 April. Everett was off-site from the week of 4 April thru 15 May. During that time he could have installed the refrigerator, dishwasher, crown molding for the pantry, quarter round for the cabinets, hardware for the cabinets and so on. I spoke with Everett on this matter and he stated that it would only take him two days max to complete the unfinished work. Everett started work again on 15 May and could not complete the unfinished work in five days. Once again, his ability to complete work in a timely manner is shown. On 20 May 17, he tells my wife he is ready for a walk-thru, which implies he is ready to finalize everything for payment. Look at the pictures and the listing of items that are not completed and tell me if he is ready for a walk-thru! Below are texts & emails regarding stained wood floors, two incidents of electrical issues/power outages, electrician and cleaning crew & electrician not showing and no phone call from Everett. (Pictures of communication would not post. I can send upon request at: [email protected])

    I can only go by the actions of someone. I emailed Everett because he was not completing the work as written in the contract. The contracted states, “Time of Completion will be 5 days after granite top installation.” The granite was installed on 28 April 2017. Everett appears to be stalling. See below communication. We set a date for him to finish the work and he messages me a couple days prior asking if the date & time are ok as if he wants a change. To my recollection he has never contacted me after I confirm a date & time to ask if things were still ok. By Everett’s actions, he gets upset when we point out something he and his crew has done wrong then he decides not to complete the work in our home (note the above where he would not come to our home to complete work after 4 April). I will not apologize for pointing out safety issues e.g. leaving razor blades in our carpet three times or poor workmanship. We are paying for a professional not some handy man on Craig’s List. We found Everett on Build Zoom it the workmanship at best is poor. There isn’t one single area that Decomar Construction Services Inc has completed that does not need to be re-worked (see listing below). Since Everett’s text message at 0640 on 5 Jun, Everett again has not called as stated in said text nor has he communicated through text or email. Please note the photo of the electrical outlet and plumbing under the sink. Typically, a cap/plate is place around item to cover imperfections in the cut outs. There are actually four holes under the sink that are not covered.

    Below is a listing of items we identified that needs to be completed prior to you receiving final payment on the remodel of our home located at 1313 Rowantree Drive Dover, FL.

    Remove stains of glue and adhesive from wood flooring

    Cleaning crew to clean areas over exposed to dust during demo/remodeling

    1. Rear hallway
    a. replace broken door assembly (piece will be purchased)
    b. fill hole in wall where door knob punctured wall and touch up hole
    c. repair drywall & paint wall near baseboard where paint came off during baseboard removal
    d. remove masking tape under baseboard

    2. Linen closet.
    a. repair drywall where tile/baseboard was removed

    3. Kitchen.
    a. microwave cabinet: fix gap between corner scribe molding. based upon the result, glue seem to be the better way as it would have ensured the pieces were even and flushed together.
    b. fix gap/even the pieces in refrigerator ogee. based upon the result, glue seem to be the better way as it would have ensured the pieces were even and flushed together.
    c. fix gap on ogee for dishwasher. based upon the result, glue seem to be the better way as it would have ensured the pieces were even and flushed together.
    d. remove glue from refrigerator wall panel
    e. fill hole from nails and touch up from decorative doors
    f. electrical cords exposed on pendant lighting

    4. Nook
    a. t-molding not secured to flooring
    b. remove white molding and replace with original stained wood molding

    5. Family room
    a. remove adhesive from wall behind the sectional and paint if drywall is stripped or discolored during removal

    6. living room
    a. replace broken light plate
    b. remove white plaster from wood baseboard
    c. finish quarter round from living room to nook...also a small angled piece of the quarter round came off in the living room
    d. repair/reinstall light plate indented on the wall

    Blue tape is placed in areas of concern/punch-list in case I missed something.

    Areas missed not in above
    1. Electrical wall outlet in family is not connected to the appropriate plug-in outlet as previously connected prior to remodel. Top electrical outlet is for the switch while the bottom outlet did not use a switch to turn item on while plugged-in
    2. Seal/cover holes around plumbing pipe and electrical outlet under the sink cabinet
    3. Wood flooring in hallway not glued to floor. Pieces move and/or make awkward sounds when walked on
    4. Outlet in living room & den pushed-in and not at the level of other outlets on the same wall plate
    5. Check the inside of cabinets. Some holes were filled and touched-up while other areas were not
    6. Phone line in kitchen not working
    7. Electrical switch/panel for chandelier gets extremely hot when turned-on. The chandelier also, will turn on and off on its own.
    8. Fill-in and touch-up for crown molding is not consistent and appears to not be IAW good workmanship.
    9. Motion detector that was disconnected in the nook area is not working.
