We hired Ricky DeMartino's company to do the concrete work around our inground pool and build 2 necessary retaining walls. This was the summer of 2013. He claimed that no permit was needed for our township due to the walls being less than 4 ft high. When everything was finished (pool, electric, fence, concrete and walls) and the township came out a month after Ricky was done to do our final inspection, they failed the entire permit due to no permit for the retaining walls. They said if the retaining walls are structural, they need a permit no matter what the height.
We have been in contact with him many times since then and he gave the same story of "just have to get an engineer to sign off and get the permit and it's done." Haven't seen him. Last return communication from him was last year at this time in which he stated, "Been in touch with the town. Working on getting engineer to sign off. It's all the town needs along with fee for the permit that I don't have right now. Town knows I am working towards an end. Only if you were trying to sell the house would open paperwork become an issue. I expect to be through with this by the end of next week."
Our thoughts on this are: the fee he claims he doesn't have amounts to $175. We have to believe that since that is not a lot of money AND it's been 2.5 years there must be another reason that he is not getting an engineer to sign off on it. ie. it was built wrong and he knows it won't pass...? A month ago, we contacted him again and said if we don't hear from him, an attorney was our next step. Have gotten no response so that is the direction we are headed now.
We also asked him to straighten our railing leading into the pool that he cemented and of course he has not done that either. It's a shame that every other contractor but him made our pool-building experience an easy one.
