Dk Building Construction

This company has unresolved issues with my ongoing construction of the restaurant. This company, DK Building Construction, LLC, has another name called A&I Contracting, Inc or AICON USA, in 2020 when they worked as the General Contractor for my restaurant construction. They left after receiving a total of $85,000 payment and only completed about $10,000-20,000 work (to my best judgment and other experts' judgment). Besides, they provided me a certificate of liability insurance which has never been effective and the check they sent to the insurance company was bad. Here are the details:

My space for the restaurant is empty. Based on the signed contract, I paid $51,000 as the first payment in June 2020. In the beginning, they looked nice by breaking the ground and did some framing work and drywall. On July 23, 2020, they asked for the second payment, which was not due, but they justified it as follows:

"2nd payment request was made and approved for $34,000;
Need to place an order for the hood (due to their lead time)".

Because I am new to this field and also did not want to have any delay of my construction due to payment issue even though during the COVID pandemic, so I paid them ASAP by wiring (they asked for wiring). Right after they received the 2nd payment, I could not get in contact with them easily. One day, they told me the hood has been ordered and expected to be delivered on August 26 or so. These things went on without any progress.... after completely losing contact - they did not take my call or respond to my message. I stopped at their office which was left the only way I could talk to them. However, they asked me to wait outside in the parking lot for 30 minutes before they can see me... which was a totally different attitude as they were when we signed the contract and working on site. They told me a lot of internal issues with their company and partnership and excuses none of which were reasonable to me. I asked for returning at least $34000 which was asked for they have stopped working. They ignored my request. In fact, the hood has never been ordered at all. The money of $34,000 has never been used to purchase a hood at all!!!!

The targeted completion time for this construction is at the end of October 2020, however, due to their drop on my construction, the work is still not completed yet (7 and half months).

This experience was a big surprise and lesson to me!!!!!!!
As a new business owner, and during the difficult time during the pandemic, they dropped all the works after receiving the paid $85,000 with only less than $20,000 work done!!!!!!!!!!! An image can be found under this review right after they left.

To make things worse, now it is tax season, I have asked them to send me the W-9 form by one email (their previous email is not working anymore), three text messages, two phone calls (one voice message), but have never got back from them yet!

At this time, I am working on legal ways to keep them accountable and will share with you more when it is time.
