    Eric backed out of a contract and accused client of lying

    tl;dr: Eric backed out of our project after signing a contract, committing to a start date, asking for a 23% advance payment on labor alone, and after I had already sent him a check for the advance. On top of that, he accused me of lying, stopped all correspondence, and wrote things like: “If you actually did send the check then I will tear it up and send it back to you” and “You are the disappointment”. That’s not a professional manner to interact with anyone, much less your clients. Canceling a project at this late stage has consequences: I had to scramble to hire another contractor so our project wouldn't be delayed, and I wouldn’t have to pay the tile vendor extra to hold the tiles at their warehouse for too long.

    Longer version: I reached out to Eric for an estimate after seeing good reviews on Yelp (May 14). The first time, he simply cancelled via text without offering to come by later (May 16). I texted him back (May 19), and he showed up (May 20), and sent me an estimate over email after I sent two more texts (May 23). After we decided to have him do the job, he sent me a contract and asked for an advance on labor (not materials!) upfront (May 25). We worked out a final contract (June 4), a start date (June 22) and I ordered tiles myself. He wanted to come by and pick up the check the very next day (June 5), but I forgot to leave it under the doormat that day, so I immediately sent a check through my bank’s web site (Capital One 360) (same day, June 5) and sent him a screenshot of the bank's confirmation.

    His contract says he needed to receive the advance payment 5 days before the project start date (that would’ve been June 17). But then, a long time before that, 15 days before the scheduled start date (on June 8), he sent me an email—no phone, no conversation—saying that he wouldn't do the job because he hadn't received the check yet. According to his own contract, there were still 8 days left before payment was due. The bank confirmed that the payment was indeed sent correctly on June 5, and would be received by June 11 (6 days before it was due). Eric still insists (June 22) he never received the payment, so I opened an enquiry with the bank, just so I have written proof. They did their investigation and concluded that it was sent out correctly on June 5. I have maintained written records of this entire ordeal, because I do not take lightly any accusations of lying.

    To sum up, Eric was extremely unprofessional in accusing his (potential) customer of lying without any proof to back him up, before any payment was even due. Instead of communicating to resolve whatever issue might have occurred (sure, postal mail does get lost sometimes), he sent out a terse email, breached his contract and cancelled the job unilaterally, placing us in a tight situation. Eric has shown himself to be undependable & unprofessional: I would not recommend him for any job.
