Florida Pool Tech was hired and signed to perform a light installation at the rate of $325 as defined in original signed agreement. Prior to installation, all information of the “light kit” to be installed was provided to FPT (Florida Pool Tech). During installation on hour 5x, we notice an 8 foot hole dug in our backyard, a safety hazard for our 4 year old son who typically plays daily practicing soccer. After noticing the giant hole, we approach the technician who says “do you want the good news or the bad news”, to which I replied “I would like the truth”. The technician informed me that “he does not have the strength” to pull the cord through the conduit (technician is a paraplegic weighing roughly 100lbs with one full prosthetic leg) and therefore dug an 8 foot hole to “get a better grip”, to which still failed. I was informed a stronger larger man has to come the next day to do this job due to the insufficiency of this employee (not my responsibility). The next day, the hole gets larger, the cable gets pulled through, and Im informed the brand new $400 light “does not work” with the “Wrong voltage reading”. Headed out for Thanksgiving I leave the employees working hoping for good news upon my return. I manually check in for answers on Monday 12/2/24 and receive 3x texts from 3 different numbers to call into the company. After a brief discussion, I am informed additional costs will incur as the owner only planned for a 1 hour job. Stan, a phone representative, admitted that the employee performed work “outside of the scope” of the original job and they original budgeted for one hour of labor. Stan admitted the technician was not authorized to perform the work required, and also purchased items from Home Depot which is not allowed by the company under any circumstance. We terminate this phone call with a mutual agreement for a new estimate to be sent tomorrow (12/3/24) for approval. I’m a very fair person, multi business owner, and expected higher costs; although this is not how this went down. FPT spammed my email with 3x amended invoices from morning to middle day (12/3/24) with the last invoice (which is over double the signed invoice with random line items) showing paid. This transaction is not approved, authorized, or even mentioned/discussed in any way. A new number is written, new services are added, a signature is copied from a previous invoice, and my credit card is billed; please note that the work is still not done correctly - and the company is claiming that the brand new, 4.7/5.0 star $400 light is “faulty” and refusing to offer further services without an additional purchase of a $300 light from their company. Please note that this invoice also includes a $74.11 receipt from Home Depot where the employee apparently “went to the store and purchase additional required equipment”. This was both unauthorized, and did not even result in a correctly working light. I called Stan immediately, this took 6x calls, one to which I was hung up on when a customer walked in. Stan stated “they tried to reach me all day, so they went ahead and billed the card with no authorization”. Admissions from Stan and the employee it is clear the company planned for this to be a 1 hour $325 install, and mistakenly sent an employee to go rogue creating fall hazards, mud all around the pool (requiring cleaning services), self provoked purchases, and converted this into a 2 day project due to “lack of strength”. After repairing holes ourselves, funding a cleaning service to fix the mud stains on our concrete pavers, and left with an open electric wire less than 12 inches from our pool; it should be understand that we have already paid a price ourselves; and although courteous enough to offer additional funding for the additional labor, not to be billed against our will at a random amount, with random line items. This is poor business operation and should be a loss to the company, not a loss to an innocent client who signed for an alternative service and provided all light information to the company before signing off for a “light install” only. With multiple violations to the TOS, we are filing to terminate liability of both contracts, and dispute this transaction in its entirely. See below direct references from TOS that violate the original contract. We have hundreds of dollars in repairs to cover, a hole to fill, an open wire to seal, and already funded $125 in cleaning services. This is all before we find another company, to start and finish the install correctly without creating liabilities or fraudulent charges against our credit card
