Our firm inadvertently sent a check for $13,647.50 to Frontier Construction in June 2014 that was NOT due to them. They cashed the check, never notifying us of the error. In October of 2014, when we discovered the error, we contacted Frontier to request they return the funds. They took our initial calls, but then stop responding all together. To date, they have not responded to our calls, emails or those of our attorney. Keeping funds not due a firm is conversion, fraud, money had and received, and violation of Oregon’s Unlawful Trade Practices Act (“UTPA”).
