By Ana W.October 25, 2018Condo Remodeling$200,000Response from Gafco, Inc November 20, 2018George Frudakis is the President of Operations for Gafco Construction, Inc. (Gafco). Gafco was contacted by Ana Piumbini, owner of SRQualityKitchen & Bath (SRQKB) after her son was deported due to shooting a guy in a bar. Ana asked Gafco to take this project on. Gafco agreed to do so in the amount of $80,000.00 for labor only and all material needed to complete this project where to be supplied and delivered to the job site as per the contract dated, April 11, 2018. A fully executed contract between SRQK&B and Mr. and Mrs. John Wharton, dated April 10, 2018 was given to Gafco to bid the project as a subcontractor. SRQK&B was fully aware of the scope of work requested by the Wharton’s and agreed to Gafco’s terms and conditions for the project. At no time was Gafco to supply any building materials, including products that SRQK&B deemed as part of their business. Gafco had no way knowing what the customer had ordered under their contract with SRQK&B. That is the reason Gafco entered into a labor only contract with SRQK&B. Any and all building materials were to be ordered, paid for and delivered by SRQK&B. Mrs. Piumbini accusation that Gafco ordered the wrong valves is completely false. Gafco has no way knowing what valves to order given that the contract with SRQK&B & Gafco was for labor only and not to bear the responsibility ordering any of the required valves or their finish. Gafco did inspect the valves order by SRQK&B and found them to be working valves and installed them per the contract. Gafco had to demo an existing finished wall and replace the same wall with new tile after the valves where replaced (That is the 3,118.50 invoice). SRQK&B went directly to the plumber to order the new valves. That is where the $2,582.93 subcontractor payment come into play. Gafco had to pay the plumber $919.35 to install the second set of valves, after receiving the correct valves Mr. Wharton had originally ordered. SRQK&B ordered a tub with center drain, they should have ordered an end drain tub to be installed. Gafco was not consulted on the tub to be ordered. SRQK&B did not want to return the tub and get the correct one, so the only way to install the incorrect tub was to elevate the floor for the fall. SRQK&B ordered Gafco to elevate the platform on which the tub would be placed. When Mr. Wharton inspected the tub, he did not want the tub elevated. In the end, SRQK&B was solely responsible for the ordering incorrect tub and adding the elevation, which the client did not want. The elevation was removed by Gafco and the tub placed directly on the tile floor. During the construction process Gafco’s trucks and SRQK&B subcontractor trucks leaked oil onto the driveway. Gafco pressure washed the driveway. SRQK&B also pressure washed the driveway that same week. Gafco paid for the pressure washing cost from SRQK&B in the form of a deduction on the invoice. Since then, SRQK&B subcontractor, David, re-stained the driveway and washed out in the planter bed which, Gafco cleanup for the third time. The water intrusion was caused by a toilet line, after the toilet was flushed. The line leaked causing water to enter the downstairs unit. Not by a fire sprinkler leak as stated by SRWQ&B. Gafco cleaned and dried the small water penetration to the satisfaction of the property manager. The gentlemen in the downstairs unit was concerned that mold would form. A mold remediation company was contracted to inspect the area and all tests came back negative for mold. The property manager agrees with the findings. The owner requests a second inspection that was performed and Gafco and reimbursed SRQK&B the $599.00 on a discounted invoice. The workmanship issue is not on the part of Gafco, but rather the poor-quality kitchen cabinets, paint, tile selection and appliance that need to be replaced. The shelves in the kitchen are of poor quality along with the installation of the cabinets that SRQK&B performed alone to make the cabinet fit after ordering the wrong units. Not counting the split seams on the cabinet’s doors. The drywall work that SRQK&B tried to do left the corner bead 4” on the top and 2” on the bottom. SRQK&B broke the elevator door and left the cabinets in need of finish work. These added corrections were above and beyond the scope of work for Gafco. Given the fact that SRQK&B is no long in business and the reputation of Ana Piumbini has been tarnished through her failure to satisfy her contractual obligations on multiple jobs, Gafco was forced to place a lien on the property. Ana Piumbini sold the company, to Nick Racanelli on, who has requested his money back due to the complete misrepresentation of SRQK&B by Ana. Please review the letter from the project owner in question, Mr. Wharton, which will paraphrase all that we have asserted in this letter. There are currently two law suits with respect to litigation with SRQK&B and two more to be filed.

- Building permit records show that Gafco, Inc has worked on 62 permitted projects.
Gafco was hired on March 2018 to do a full condo remodeling. This job was supposed to be done in 90 days. Today is 10/25/2018 and the job is not done.
They over charge on material, their quality of work is poor including but not limited to the installation of the tile which the installation was terrible. When I asked to have the job fixed, they just abandoned the job and stopped work and demanded more payment.
I was unhappy with the quality of the job. I tried to hold the payment. However, Gafco then put a lien in the customer’s house.
In order to try to find a solution, I paid everything else even the part of the job what was with problems and needed to be fixed. I hold the payment of 5% of the job part of the contract for punch list, some material charges and 4 “re-start fee” - $ 800 dollars each one in the total amount of $ 3200 on re-start fee only. I was never informed that was going to happen. They just stopped the project and charged me for a “re-start fee.”
They informed later on the project was stopped for lack of material and/or lack of payment. The payment was not done because the work performed was not acceptable and needed to be fixed. As soon as they fixed the outstanding issues, I made the payment.
The other explanation to charge me for “re-start fee” was lack of material. However, they sent me many invoices charging me for material and request reimbursement without never explaining where, when and what quantity of material they were buying to finish the project. Lack of material should not be a reason to stop the project, especially if Gafco was buying material and requesting reimbursement.
I already sold the cabinet company that sold this project. Most people in a situation like this would get tired and stop. But, I cannot do that. My name and my reputation in the market is very important to me, I need to finish this job and deliver to the customer the condo, finished and with a good quality of work. Gafco abandoned the job without finishing and then they demand more the $ 20,000 on full payment of all the material and all the fees without any date to finish the project.
They demanded of me to make full payment of this amount and refused to commit any date to finish the project or to finish the punch list.
On top of this problem GAFCO damaged the customer drive way with truck oil, I already paid to pressure wash this drive way and the oil did not get out. GAFCO refused to fix this problem and ignored the HOA complaints. The owner of the company, George, promised to me that he would fix this problem because the customer was complaining about 90 days ago. Instead of finding a solution, they abandoned the unfinished job and demanded full payment before they would fix the problems and finish the punch list.
I strongly recommend that you never use this company. Never sign any contract with this company. His contract is very protective for his company and any problem they state “the language of the agreement states the following:”
“If clients, fails to render payment according to the draw/payment schedule within tree (3) days of receiving contractor’s payment request, the contractor may cease all work concerning the project.”
It doesn’t matter if you complain about the quality of the work done. They will stop the project and request full payment before they will come back and finish and they will charge you $ 800 (eight hundred dollars) for “ re-start fee” every single time that you complain about the quality and GAFCO will request a full payment in order to finished the project.
I tried to fire Gafco and hire another general contractor they blackmailed me informing the permits are not transferable and even if a hire someone else to finish the job they will keep the lien on the customer’s house and they will demand full payment no matter what. I did file a complaint with BBB and the State of Florida and now I will send all the documents to the State to see if someone can help me to find a solution about this problem.
