In early 2024, we hired Smith-Garner Construction, LLC to perform major residential renovations at our home. Despite receiving substantial payments and engaging in permit applications, the contractors abandoned the project without cause, obstructed our construction loan process, withdrew city permits without proper authorization, and left the project in a non-functional, incomplete, and financially burdensome state.
We followed all required legal protocols under the Texas Residential Construction Liability Act (RCLA) and Texas Deceptive Trade Practices Act (DTPA) by issuing a formal 60-day demand for cure and reimbursement. Instead of responding professionally, the contractor replied with mocking and hostile emails (including “LOL,” “you guys are a train wreck,” and “goodbye”), refused to offer any explanation or restitution, and failed to cure or even acknowledge their obligations.
We are facing:
• Significant financial damages due to incomplete construction and loan-related fees,
• Obstructed permitting with the City of Dallas,
• Emotional stress and logistical hardship from project abandonment,
• Threats of an improper or fraudulent mechanic’s lien from the contractor.
We believe this constitutes a violation of the Texas DTPA, including knowing and intentional misconduct, and we request that your office investigate this matter for consumer protection violations.
We are also preparing to pursue legal action in Dallas County to recover our damages and prevent this contractor from misleading or harming other Texas homeowners
