Regretfully , unbeknownst to us before commencing our major build and renovation, this builder decided to start a tavern in another part of the state. His subs informed us that he was not present consistently at the build, yet continually complained to us that he could not get good workers. When problems exploded, along with his explosive tantrums, after seeking counsel from people within the industry, we appealed to the builder to come to the table with tangible solutions. He retorted with threats of a defamation lawsuit against us because we had sought counsel on best next step approaches. Months later in mediation, he informed the mediator (a retired judge) that he would not take responsibility for the problems and his violation of the contract, informing the mediator that he would just file for bankruptcy if we filed a lawsuit. We were thus regretfully forced to file a lawsuit, not only against the company, but him personally because there was clear evidence of no identity differentiation between his company and him personally. Total cost estimates from engineers to fix damage and complete the project exceed $400k, with even more legal costs that are costing thousands of dollars a month. Two subs filed lawsuit against Gonder Construction for non-payment. With claims now against his bonds, he has obviously not renewed his license. This is the regretful case of a builder's pride destroying a formerly good company, and leaving a homeowner in terrible peril, with insulation hanging out, no kitchen, no heat, when he decided to walk off the job. Without legal protection, we could be facing financial ruin. Mismanagement and overstretch has sadly destroyed not only a building company, but also people's homes and lives who were left with his mess.
