Do you pay your employees under the table, avoiding having to pay state and federal taxes and workmens compensation? I have read a notarized statement that a Michael Saavedra submitted on behalf of an employee stating just that? Is this ethical? Do you provide that employee a 1099?

I just received an e-mail from the NM Department of Labor that states that this company does not exist as far as the Department of Labor is concerned. The license # is not listed anywhere in their data base. This is what the e-mail from the Department of labor said.....
We are unable to locate a company by the name you’ve listed below. There is a G.S. Construction in Santa Rosa but the license is not the same. A construction company must report all employees wages unless the person is not an employee and is a bona fide Independent contractor and can prove he/she is able to work as an independent contractor. To answer your question, yes it is illegal and yes Felipe Chavez must report his income.
