Permits

After living in our new home in Piperton, TN (Twin Lakes) for only 3 1/2 years, we are now going to have to replace the entire 33 x 7 upstairs balcony because of three items not completed at construction -
1) No flashing was installed below the tile
2) No water/ice membrance was installed between the tile and plywood
3) The tile was cut around the columns instead of placing the columns on a solid piece
The wood has rotted and water is now running down the columns on the downstairs porch. The original tile person, framer and another contractor all tell me it was the fault of the builder. The builder says we should have performed maintenance on the house (caulking around the columns) and he can't guarantee a house for years. The area he's speaking of is not visible to the eye - you have to remove the column to know it has been cut around and there was no way to know the rubber membrance wasn't installed. I brought this area to his attention within the first few months of moving in and his remedy was to tell me to wait until my year was almost up because the painter would only come out once and once he did, we wouldn't get anymore touch-ups.
Our comment - I wouldn't expect to have to totally replace a balcony within 3 1/2 years in a house that cost us $525M.
