Hello,
I purchased a home in the Highlands 2 years ago and my realtor referred this guy to me. I know this was over two years ago but this guy has taken no initiate to fix the problem. He "Sub Contracted" an electrician to install an new electrical box in my home. It took way longer than he originally stated. This was not a big deal to me as long as the job gets done correctly. I paid Mr. Demian Pitts, Owner of Highland Carpenters Guild and he was on his way. I noticed that a light in the basement was not working and also a electrical plug in the kitchen. I called Mr. Pitts and informed him that the light in the basement was not working and the electrical plug in the kitchen was not working as well. He stated he would be in touch with me to correct this. I had not heard from Mr. Pitts in a few weeks so I sent him an email and replied stating that since I had already paid him that contract had been satisfied. Below is his correspondence to me regarding work that he did not complete. He is basically saying sorry but you paid me and I don't have to deal with you. The last few sentences at the bottom of the first paragraph says it all..... I paid this guy close to 4 grand!
The contracts are in the possession of Bank. There were several forms that you signed with them during the closing of your loan pertaining to my involvement in the loan. One of them would be labeled Homeowner/Contractor Agreement. If you want to contact the bank, I'm sure they would be glad to give you a copy. You may already have one in your closing papers. If you closely review these agreements, you will find that I have the right to collect payment for services rendered upon completion. Since you have already paid me, you have technically agreed that work has been completed. You would have also signed a document for this in order to get your final payment from the bank. I know you have very little experience with this process, I however assure you that I have been doing these types of loans for years and have been very thoroughly versed in the contracts involved. A contract does not have to be labeled "VOID" in order for it to be, in fact, void.
I stated clearly in my previous email that I fulfilled my obligations and did in no way state that I did not complete the job I was contracted to do. I do acknowledge, as do you, that certain things in my estimate were completed by contractors other than myself, and I refuse to assume liability for their work, nor to I claim that you owe me any funds for said items. Also, I have never in my own paperwork represented that I guarantee my work for any period of time. I know this seems like an underhanded tactic, but it is an omission that was intentional for these exact situations, where other contractors and unseen pre-existing conditions are potentially involved. The basement lighting was never mentioned in the bid I submitted, therefore I am not obligated to complete that portion of the work. I offered to out of a feeling of obligation to my work ethic. I should let you know that this does in fact bother me, and wish that I had been more able to resolve the problem before it came to this point. I am not trying to make excuses, merely trying to cleanly state my position.

Also thank you for acknowledging the fact that it is 6 months later and your company has not completed the job that you have been paid to do. I'm sorry that you feel that I am passive aggressive towards you and your company. It just makes me wonder how you expect a customer to act when then have been told something and all they hear is excuses, my phone hasn't been working, the electrician was suppose to contact you,? Most people I know tend to get a bit frustrated when they pay money for a service or product and are not given what they are told.
Please send me a copy of the signed contract that was voided when I chose a more competitive bid from another licensed contractor. I was not aware that this was voiding the contract and how the roof patch job and chimney repairs would effect the fact that the electrical box was not wired correctly or still has defects. You were aware that I was using another contractor and you should have drawn up a new contract for me to sign. Can you please send me a copy of the contract you say is "voided"? I would like to have this for my records.
After the fact that you have not completed the work you stated you would and I also have a faulty electrical socket that is ruining devices like digital fans and air purifier I would prefer that you and your company not work on my electrical problem that I am having. However I will let you know what the other electrician has to say and if this is a fire hazard. I do not want any problems I just want clear answers and nobody pulling my chain. So please send me a copy of the contract I signed.

I've looked over our past correspondence via emails and reviewed the contract we had. I am aware that I told you several months ago that I would repair the basement light issue, and I am still willing to do that, though very reluctantly. My hesitation is because of your manner of speaking to me in a passive-aggressive nature by saying things such as "I thought you were a man of your word, but I guess I was wrong" and "you can come fix this or I will send you the bill, your choice." In most cases, I would bend over backwards to maintain a good working relationship with previous clients, but I cannot validate the effort required in this instance.
Our initial contract was voided by you when you chose to use other contractors to do work (such as roof repairs, chimney repairs, etc.) that I was contracted to do. I had already given you a break on the pricing of the estimate in order to meet the parameters of your loan. The contract states -"Several wires have been cut and removed. A new panel must be installed due to the age of the existing panel and the lack of availability of a new front cover. All missing wire is to be replaced with Romex of proper length and gauge from the new panel to junction boxes installed at each severed wire. Amperage testing will be performed to the best of the ability of the electrician to ensure proper breaker amp limits are used. All new circuit breakers will be installed. Sub panel should be removed and wires should be incorporated into the new panel.... No new outlets or switches are to be installed unless deemed necessary by the electrician. "
We did much more work than was stated in the contract including but not limited to- replacing several outlets, combining service from the second meter, running independent grounds to several outlets, and adding 3 circuits to the original configuration. Some of the wiring in the house was BX or MX metal shielded wire which is not considered a proper grounding method by current standards. There is the presence of some knob and tube style wiring in the walls which also could be causing the problem. Also, the outlets, fixtures, and switches that were in the house previous to our repairs could be faulty. We do not claim responsibility for the materials used or work performed before our panel and wire replacement and therefore cannot guarantee that the old wiring in the walls is not to blame.
Therefore, I have fulfilled my end of the contract, (which was voided by you as previously stated) and feel that I no longer need to be concerned with the problems you are currently having, eight months later. You have no legal standing for sending me any bills regarding any work that may be performed for any future electrical repairs, therefore any attempt to collect money regarding this matter will be considered invalid.
If you wish to contact me to attempt to repair the basement lights, please do so via email only. I do not wish to speak to you directly, and I will not answer your calls. I will send one of my employees to do the repair and will not enter your property personally unless deemed absolutely necessary. The only reason I would do this is because I stated that I would in writing.Thank You,

Worst contractor ever! Very unprofessional. Work is always behind schedule, then botched and very very sloppy. It has been a nightmare working with this business.
