OK, here is a cautionary tale, that will hopefully get you to think twice about hiring this shady contractor;
They were hired to do a $214,000. job here in Las Vegas, and after a grave comedy of errors, culminating in them abandoning the job, they were subsequently fired.
But that's where it really gets interesting......
At the time they were fired for abandonment, they had taken a $108,000 deposit, and had layed out right around $88,000 to subcontractors, permitting, expenses, etc... (This math all came out in depositions given by them, bear with me.....), netting them a profit of around 20% up to that point for the work done, which seemed more than they deserved, but I wasn't going to quabble over a few thousand dollars, I was just happy to get rid of them.
So imagine my surprise, when they put a lien on my house and SUED me for just over $64,000, with their claim being that $64,000 was the next payment due, per the contract, that they had abandoned, and were not continuing work on, per being fired.
So my initial thought was that maybe they thought if they could cause a bit of hassle, that I might just throw a few dollars in settlement money at them just to make it go away?
Yeah, they clearly picked the wrong mark, because what I told my attorney was....."I don't care if it costs me twice that money in legal fees, as long as these grifters don't get a penny."
This suit dragged on for around 8 months, during which, a lot of really nutty things came out about this company, including my personal favorite.....that their contractor's license was only good up to $200K, so they were not even permitted to bid/perform work on this $214K job, rendering their entire contract null/void, as well as potentially exposing them to sanctions by the contractor's board.
Anyway, long story short.....we just settled the matter, and instead of me paying them $64,000 as they had hoped, THEY had to pay ME $19,000, which was a happy ending.
The settlement REALLY shined a light on the merits of their case, (or lack thereof), if by the end, they were throwing settlement money at me as an alternative to actually going to court.
It really affirms my original theory that they thought they could make a quick cash-grab by bringing this nuisance suit, but in the end, paid ME $19,000 to settle out of court, which I suspect is because they assumed that they would lose in a jury trial.
So there it is in a nutshell, boys and girls, and let this be a warning to everyone........Avoid this unscrupulous contractor at all costs.
