We had been working with Dustin Hart of Kingston Homes (as well as South Texas Photography), along with James Sandoval of Prime Real Estate.
We gave $5,000 to Dustin & signed a contract with James (as Dustin's representative) for a major project we were all working on together .
The project never got off the ground.
Out of that $5,000, we authorized "a couple hundred dollars" for a computer program & received a few pics from (supposedly) that program - we never received an invoice or were even told the final cost of the program.
Everything was canceled as funding fell through.
We requested our $5,000 (minus any out of pocket costs) be refunded.
We were told by James the contract states that returning any money was "at the builder's discretion" and that nothing would be refunded. (along with a promise that if we want to move forward with the project at a later date, that they'll **hold our money for us**.
Contractually - they are within their right to not refund the money.
MORALLY:: THEY TOOK OUR MONEY. WE RECEIVED NOTHING IN RETURN. And according to the contract, IT IS DUSTIN'S (as the contractor) DECISION WHETHER OR NOT TO RETURN THE MONEY.
He is CHOOSING not to.

We feel we were taken. Don't let them do this to you.
