Modern Installation Solutions, LLC (MIS), a General Contractor, made false and misleading representative statements intended to induce us to enter into a contract and they were successful. During the summer of 2020, we reached out to the Florida PACE Program and MIS in turn reached out to us. We met with MIS several times over the course of several weeks. We disclosed that we were also in discussions with several local roofing companies. MIS responded by stating repeatedly that MIS had been in business for over 30 years and “Their Roofer” were the best in the business. MIS DID NOT disclose that “Their Roofers” were not their employees and MIS was legally required to hire a roofing subcontractor. MIS recommended that we not hire a local roofing company because they are not General Contractors and they “come and go.” We have a flat-mansard style roof and MIS advised us that they can be prone to leaks if inadequate material is installed and/or work is performed. Accordingly, MIS made specific recommendations, including a buildup of rigid insulating board on top of the plywood sheeting which would slope downward in four directions from the middle of the roof towards the roof edges to prevent water from accumulating on the roof surface and at the roof edges. MIS stated that "Their Engineers" would design the proper sloping. MIS advised that our current roof at the drip edges was not installed correctly and “Their Roofers” would ensure that the work was done correctly and standing rainwater would not accumulate on the roof and at the drip edges. MIS stated that all materials would be delivered "directly to their warehouse," but the supplier delivered the materials directly to our home and placed a lien. The day the work began, unknown individuals showed-up at our home unannounced. There were no identifying markers on their vehicles. We called MIS and after disclosing that MIS hired a subcontractor, we stated that MIS had made serious misrepresentations and lied about “Their “Roofers”. The MIS subcontractor had only been in business for 3 years. We watched in horror as the subcontractor taught his employees how to use a basic nail-gun. The MIS field supervisor was onsite once. The subcontractor was often absent from the job site and left his unqualified employees unsupervised. As the work was progressing, we observed numerous errors, but MIS was nowhere to be found. The subcontractor's employees spoke little English. We reported numerous problems and work deficiencies and sent photographs to MIS, but MIS told us it was a "Perfect Roof and he has seen worse." MIS installed gutters via another subcontractor after the permit was closed and the third-party contractor caused major damage to the roof drip edge exposing the buildup and plywood creating significant risk of leaks. MIS offered but has not fixed defective gutter work and damage. The buildup was not installed correctly, the slope is not accurate and has numerous flat sections leading to standing water throughout the roof and at the entire drip edges. MIS told us that the roofing material would be secured throughout the roof area, but it is free floating. This seems contra intuitive for an area prone to hurricane winds. What a disastrous $45,000.00 reroof. We complained to MIS under the warranty, but they have not responded to the defects other than to assert that it is a perfect roof. We only have a 2-year warranty which will expire soon. MIS is not honoring their workmanship warranty. MIS misrepresentations and failure to honor their warranty are clear violations of the DBPR regulations and Federal and state Unfair and Deceptive trade practices rules and regulations.
