On June 1, 2012 I entered into a contract to install vinyl wrapping around the porch columns and cross beams for the four porches of a duplex at 3215 Lamb Ave, Richmond, VA 23222. The proposal called for 1/2 of the total labor cost of $400 before work would begin. i spoke with James Moseley regarding the $200 requirement up front and he insisted that he required that amount because former customers had not paid him when due. He promised to complete all the work by Monday, June 4, 2012. Against my better judgment, I paid him the entire $400 on that promise.
NO visible work was done on June 4th, and the excuses began. He claimed he could do no work in the rain, and the job was more complicated than he thought, but that he would definitely have the work completed by Wednesday June 6th. He did manage to partially wrap one column, but was no further along by june 8th. He claimed a family emergency on June 8th, but again gave assurances that the job would be completed by June 11th. The job went incomplete once again although the remaining columns were also partially wrapped over June 11th and 12. Again, he provided excuses and promised the job would be completed by Friday, June 15th. He did no work June 13th, 14th and 15th. On June 15th, he once again provided excuses, and promised the job would be completed by Monday June 18th, but refused to do any work on Saturday, June 16th. So of course, the job has not been completed on June 18th. Note that each time the work was postponed my property manager or I had to call him to find out why the work was not completed as promised. He never contacted me a to explain the issues that apparently were more important than completing the work; nor was an apology ever offered.
i am now seeking a replacement contractor to finish this work so that I can hopefully rent the two units by July 9, 2012 with no remaining work needed. I am also filing a claim with Richmond Circuit Court for $200 plus court costs.
