Case Summary
In January of 2023 I hired Bryant Parks from Parks Brothers Construction to build an addition to my garage. We signed the contract on 1/15/23. As specified in the contract I wrote him a check for $1000 to get started. He said it should only take a couples weeks to obtain the building permit.
Two weeks later on February 2nd I inquired about the permit and he said he turned it in at the beginning of this week, which would have been Monday January 30th.
Another two weeks later on February 18th I asked for an update and Bryant said he's working with the building department and everything should be good to go and looking to break ground this week.
On February 23rd I called the Hamilton County Building Department and they told me there are no applications for any permits for 1145 Pamela Rd. We spoke at length and she assured me that any application submitted would be in the computer. I asked Bryant for the permit application # and who he is working with at the building department and since then he has completely ghosted me, not replying to phone or text messages.
On Thursday March 2nd I notified Bryant that our contract is terminated under section 6.1.a. "is incompetent or negligent in the execution of his contractual obligations;". He is purposefully dishonest and never attempted to apply for a building permit. I am suing for $1000 to recover the initial check, an additional $1000 for 2 months of lost project time and effort, and court costs.
