This document shall serve as your warning notice to cure breaches for the above referenced project. The following items constitute your breach.
"A general contractor is responsible for providing all of the material, labor, equipment (such as engineering vehicles and tools) and services necessary for the construction of the project. The general contractor hires specialized subcontractors to perform all or portions of the construction work."
Failure to complete all aspects of contract.
You have done nothing to improve this house. Painting should have never been started until all the rough construction, HVAC, basic electrical, and basic plumbing was done. You did everything backwards, and it will now have to be undone so it can be redone properly.
1: Wallpaper lines are still visible in all rooms. “Prepare the walls for paint” was bid in the contract, yet any mention of removing texture or covering lines has been met with “that’s not in the bid.” You painted over all blemishes, gouges, dents, etc. that are visible on the walls. You claim not in bid, but it is. If you under bid, that is on you. ($450 bid to prepare walls)
2: The bathroom is left unfinished i.e. tile job in shower is done incorrectly. Cut tile edges are not clean and facing wrong direction. Grout is not properly applied. Broken cabinet has not been replaced. Cabinets are unfinished, i.e. no paint. You have not installed the new toilet. You have not installed the granite counter top. The floor tile grout is unfinished. The installed shower fittings are not what were requested, and are installed incorrectly. The window ledge is not finished with gaps between window and tile. You never covered the heater opening after removing old heater. (He claimed $2400 for floor tile and misc. tile for a standard size bathroom)
3: The kitchen wall’s blemishes, gouges, dents, etc. are painted over without repairs. The subfloor is in pieces and the old linoleum has not been removed. You hung light fixtures before cabinets were installed or windows trimmed out and trim painted. You installed electrical face plates before all electrical is done. You left electrical boxes open and uncovered with wires hanging out.
4: When roof was installed, you did not have roofers replace rotting wood under the eaves or replace the fascia per contract. (Roof was done correctly, but by a subcontractor)
5: Porch railing is unfinished and not to code. It will not bear any weight. And you did not saddle one of the posts correctly.
6: Fixtures, hardware, etc. are not the choices we sent to you on more than one occasion, with photos. Not one project started in the Balch house has been completed, or even done to a level approaching professionalism.
7: Wall torn out at master suite opening, is left open and unfinished. Door installed is NOT what was requested. Water heater has been moved physically but is not installed and secured. (He claimed $1600 to move it 8 feet, but left unattached.)
8: Laundry Room started and not finished. Door framed but no door. This is the “outside door -- $408” in your bid. Where is this door?
9: Did not haul away demo trash per contract.
In addition, by the end of the 48 hour cure period, the following items shall be left at the Balch house, or will be charged back to RB Solutions, Inc.:
1: Brass hardware for front door, returned without incident or claim.

2: Any keys to house and gate/garage locks.

3: ANY ITEMS purchased and intended for house, i.e., exterior paint, etc. are to be returned to house. You have been paid for these items through draws. (Partially returned)
4: ANY ITEMS purchased by us that you have in possession but not installed.
5: Return of original Roof Certification. (Not done)
The following remedies shall include but are not limited to:
1: Hiring another contractor to complete the project and charging back all costs to RB Solutions Inc.
2: Dis-allowing any and all change orders unless signed by Owners.
3: Requiring all reasonable attorney fees and all court cost to paid by RB Solutions, Inc.
4: Filing a claim against the Contractors Bonding Agent, American Contractors Indemnity Company, #100110631.
5: Filing a claim with the Contractors State License Board for license #944388.
6: After review of last draw of $18,581, which was not provided as required by you, any monies claimed on this draw for work that has not been completed constitutes fraud, and shall be charged to
