This has been a very tough experience. We were told by the real estate agent one thing and then by the builder another. Never received a spec sheet and trusted the builder. I have now discovered his agent has sent a letter to the homeowners that he is now not going to put in the road. I was told when we bought the home the road would be put in. I have a copy of the letter I can send you. He bought the property from the Agent noted below and now the dance begins. I have copied the emial below:

Subject: ROAD PAVING
Please have a discussion with the remaining homeowners ASAP Road Paving.
Remember, Terry is NOT the developer of this project and he has NO ownership interest in the road. He has NO obligation to participate in the cost associated with paving of this road.
He has generously offered to contribute while he is building, at the discounted rate he was able to obtain. PLEASE NOTE: That is the extent of his contribution. If prices rise (which they will) - his contribution amount will NOT increase with inflation.
Another reason to take advantage of his generous offer NOW:
- We are quickly approaching the rainy season which is not the best condition for paving. Winter will follow - which is not suitable for paving. By the time the sun comes out again, Terry will be done building.
Please reconsider not moving forward with the road paving. The homeowners need to decide:
Do they want the road paved?
The longer homeowners wait, the more damage and cost will be associated with the road.
All homeowners signed an acknowledgement that the HOA is responsible for maintaining the road - this is a homeowner cost at this point.
Please let me know how the homeowners decide to proceed within 10 days.

I am going to suggest we get an attorney and take legal action. I think both the agent and the builder have an obligation. She bought the project and sold it to him. I bought the first new home bought in here and they told me they were putting in the road and each homeowner had agreed to pay $3,000 each. Now I find out it is all lies.
