    Tear out chain link fence and install cedar privacy fence
    $7,800

    I had Burge Fence and Iron install a cedar privacy fence 1 yr ago. Not shortly after it was installed, I had posts loose in the ground which caused the panels to lean. I called them and sent pictures by email and finally had a couple of their fence repairman come out. They said the posts that were installed were warped and twisted and should have never been used. The posts were replaced.
    Now in a years time I am having the same problem with other posts and Tom Burge Jr came out and told me that beings the posts were pressure treated, they will twist and bow. Well if that's the case then why haven't I had problems with all the posts.
    I have sent emails and made calls and haven't had a response. Still waiting on these posts to be fixed and stabilized along with a gate that has to be forced to close and open because the post is warped causing the gate not wanting to close or open without force.
    I can't believe all of this. Maybe it's time to call an attorney. This is ridiculous.

    We purchased a cedar fence from Burge Fence about 8 years ago. When it was purchased, we were told the fence would last 15-20 years and was treated to prevent wood rot and pest infestation. Back in December, we were told by Evergy at least 6 of the posts were beginning to rot. We found this out when their subcontractors damaged portions of the fence. I contacted Burge to have them come out to inspect the posts and to quote replacing them. Despite being told the fence would last 15-20 years, Michael Burge stated the fence was not warrantied. There isn't a water problem on our property, so in my opinion the posts were not properly treated, were not properly installed (e.g. aggregate placed under the posts before pouring in concrete), or the wood was inferior. Despite the previous problems, I decided to go ahead and give them another chance since they were the ones to originally install the fence. Michael agreed to have his team apply Creo Coat to the posts to reduce the chances from this occurring again. I had to remind Michael to send the quotes and wrong quotes were sent Finally, the right quote was sent and I obtained in writing they would apply Creo Coat to the posts.The first day, they dug for 5 posts. I contacted Michael by e-mail and stated 7 were quoted. I didn't hear back. When they came to install, they showed up with 5 posts and none were treated with Creo Coat. I called Michael. He didn't remember the agreement and I had to refer him to the e-mail. He stated he would come out to treat them prior to putting them in the ground. Michael showed up at the residence about an hour later, and he said he found 2 more posts that needed to be replaced for a total of 7. I had to remind him he quoted for 7 posts. About a month after the installation, it occurred to me that it was strange to paint the posts without allowing them 24 hours to dry. So I looked up the Creo Coat instructions. Sure enough, the directions require 2 coats, each drying 24 hours apart. I was livid. I sent Michael a letter by e-mail demanding the posts be reinstalled or I would be filing an AG and BBB report. I gave him a deadline. He didn't respond. So, I filed. I alerted Michael. The following day, without an appointment, he came banging on my front door, assuming for a confrontation. I didn't answer the door and stated by e-mail I wanted everything in writing. I then began also interacting with their CEO, Dan Madasz Sr. The AG recommended small claims court. I discussed the problem with Amex and they suggested I dispute the charge. Only when I disputed the charge and sent them a copy of it, showing the funds would be frozen from their account, did they agreed to replace the posts and properly apply the Creo Coat in writing, done by Dan. That was the beginning of March. I have e-mailed Dan 4x since then regarding when the utilities are scheduled for markup and the installation date. I haven't heard back from him regarding installation. American Express resolved the dispute in my favor. In the last e-mail, I told Dan the case was resolved in my favor and stated I would happily repay them when the posts are done correctly. I haven't heard back. I shouldn't have to badger them to get them to follow through on their word. My bad, I shouldn't have rehired them. I also had problems with the original installation.

    Seemed professional and on top of things when he came to give bid. Once he was hired he told me three different dates the fence would be up and never showed on any of the dates. I had to call him to find out where they were. I can understand jobs running behind but I should not have to call to find out why they never showed up. That is not professional, horrible communication. Go with a company who can take the time to give his customers the courtesy they deserve.
