We met with Western Luxury Pools in February after deciding to invest in a pool so we could make memories and share lots of laughs with our kids. Fast forward to today and it has been a nightmare bringing so much stress and difficulty when it was supposed to be just bring fun. We currently have a hole in the ground and they have $94,000 of our money. They are refusing to finish the pool and refusing to refund us so we are able to finish it with a reputable company. I trusted they would take care of us and I should have gone with a company with reviews and experience. The owner suggested that we cancel our contract this last weekend (because they can’t or won’t perform) and attempted to cite the contract stating we now owed them an additional $10,000 when the contract specifically states that if BUYER defaults there are additional fees- not builder! Obviously, he knows his own contract and is just trying to take us for more money. I am shocked at how this has been and is being handled. We are reasonable people and have just asked for communication in when we would have a mason out (we have excavation and shotcrete done) because that’s the next phase and we could not get an answer. It’s been 4 1/2 wks since excavation and no progress. Our contract states the latest completion date would be June 14th and we can’t even get a return call from this company after paying them almost $100,000! We were hopeful we could part ways with some sort of mutual resolution that would allow us to finish our pool with another company since they don’t have a mason to finish the job but they won’t even reply to us. We also had issues where they didn’t engineer the pool to hold the waterfall we designed, pool equipment in the wrong place, waterfall base not built per plan, etc. Do yourself a favor and choose the company with reviews/experience/personal referral etc We wish we would have!
