When I hired Whale, I was impressed by the Owner, Derek Nier, but I could not have been more misled. His website promises daily supervision with and English speaking project manager, a lie. The website promises daily cleanup, a lie as garbage was piled up in front of my house for days on top of my outdoors lighting which was carelessly destroyed. I was promised a special experienced TPO crew, another lie. There are air bubbles, pooling water, patches that are peeling, areas where water is not draining due to improper sloping. The metal sections of the roof are improperly secured. One of his workers dropped a hammer off the roof smashing an existing glass tabletop. The broken glass was just left on my backyard lawn. I was not told about the incident. Derek Nier never called to tell me about the broken table or apologize for leaving broken glass all over my lawn in an area where my dog goes outside as my dog could have been seriously injured. Since Whale began, there have been 5 major leaks with extensive damage to the interior. Whale has made no effort to repair the damage or correct the problems. Whale has made no effort to effectively repair or replace their defective work. Whale has made no effort to compensate me for the damages caused by their workers just intimidation with a lien. I made all payments as per the contract and on time. I withheld the final payment of $17,900 with written notice of the defects to him far less than his damages to my home. He made no effort to discuss the problems or attempt to offer compensation for all the damage he caused. Within days, he slapped a lien on my home. I now have had to hire an attorney, filed complaints with Palm Beach County licensing, and the State of Florida DPBR. I have multiple inspections by reputable roofers confirming the defects with pictures and written reports. I also have an inspection by a highly qualified construction consultant with the same findings. Whale Roofing and Construction is a homeowner's nightmare.
