This contractor worked as a subcontractor for me on several projects dealing with hotel renovations. In the beginning, their work was professional and complete. Proposals were prepared with detail and work was completed with either few complaints from the hotel or when issues arose, the contractor efficiently rectified the problem(s). We had a long standing agreement that when projects went through my company and her company worked as a sub, a 6% commission would be included in the price. In addition, it was agreed that if I found the project and her company dealt directly with the hotel, she would pay me a 6% finder’s fee. Although my normal way of paying contractors was within 30 days, this company requested and expected payment immediately. Being a small business myself, I understood how cash flow can be limited sometimes and I always went out of my way to accommodate them. Our business relationship worked quite well until the last year. I found their proposals became little more than budget numbers with very few details. Due to the lack of detail, I often times had to make several calls to be able to develop enough detail in the proposal to meet the hotels’ expectations. There were also indications that money was a problem for that company. One Friday night I had a quick check cashing company call my home asking if I had the money in my account to cover my check to them. That’s bad business.
The last dealing I had with her company was a few months ago. I was out of town for a family death and the hotel had a project. She and I talked and she put in a bid with the hotel directly but with the understanding that her proposal would include my normal finder’s fee. The hotel agreed reluctantly to deal directly with her since I was out of town. The job did not go well. There were problems between the hotel and her company with the scope of work . She and the hotel had several disagreements. I was called several times by both the hotel and her company to try to resolve their issues. Since I was out of State, wasn’t the prime contractor on the project and had no influence on the project other than finding the project for her, she had to manage the problems herself. The hotel was extremely dissatisfied with her work and notified me that they would never work with her company again. She haggled with the hotel about being paid immediately and they expedited her payment. We talked a time or two about meeting up for my payment but between her schedule, mine and the holidays, it wasn’t feasible. So during our last conversation, she agreed to mail me my check. Weeks have gone by and no check. I have attempted to reach her by phone but she won’t answer or call back. It is apparent to me now that she no intention of honoring our agreement. I will no longer do business with her company nor would I recommend her business to anyone else. Her apparent lack of financial responsibility has apparently led her to unethical business practices. I wholeheartedly believe dealing with her company would risky at best.
