We retained DPW for a relatively small, 60 square foot bathroom remodel on July 25th, 2017. They were confident at that time that this was a two to three week project. Soon after receiving our deposit of 5,350 which was 1/2 down on a firm estimate of 10,700 they informed us they could not obtain a dumpster for demo. This status continued the entire month of August until a dumpster arrived on September 6th. While we waited, we retained them for driveway work under the premise that a large dumpster could handle both projects. A second deposit was made for this second project for 1,200, but the large dumpster never appeared. They worked on demolition for over 4 weeks and still wasn’t complete. We frequently asked for a documented plan with milestones, and were assured that the project could be completed by September 27. Our dumpster was suddenly removed on September 22nd, well before completion of demo. On September 20th they also informed us that our plumbing fixtures we on order at Ferguson, but subsequently we learned that this was not true. Additional verbal confirmations were made that they had purchased a window and door for this project. We selected our tile and DPW placed an order with the Tileshop, but they did not apply our deposit to the order. When it arrived, it stayed in their warehouse for weeks. We directly paid for our tile to prevent it from being canceled. The original plumber, we were told, either quit or could not perform the job. A second plumber removed original copper pipes and replaced vent lines, not in accordance with our original plan shared with Dan, using ABS and PEX. We discussed this with Dan, who asserted that no other solution was possible. (No credit was ever applied for nearly 800 worth of copper) Similarly we expressed that a vent be moved from one wall to another, the HVAC contractor moved it to the floor area next to the toilet. On October 4th we expressed that the plumbing vent placement was not acceptable and might violate code regarding the shower door. Despite this information, Dan proceeded with a plumbing inspection, that passed, and asserted that we should proceed. He then produced a plan calling for the plumber/HVAC subcontractors to come back and fix these issues, which would not be legal, seal up all floor and wall spaces, despite still having demo work and debris to deal with, construct a shower pan, install drywall and cement board to complete the job. No mention was made of electrical work, tile, or final plumbing installation. This plan made no logical sense and based on the quality and timeliness of their past work, we elected to terminate their involvement the in the project. After we confirmed this decision in writing, we learned of the costs for the work completed thus far. DPW claims that demo, plumbing and HVAC (with a discount from the subcontractor) came to a total 5,200, our entire deposit inclusive of our driveway deposit with no prior authorization of these costs. There is no way that showerpan, drywall, cement board, electrical, tile, fixtures, and installation would have stayed within budget. This in combination with the quality of their work, to us, indicates gross negligence.
We assert that DPW was not honest about timelines, costs, and what they had purchased on our behalf. At the time we terminated our relationship, DPW had spent over 1/2 of our deposit (including that for the unrelated driveway), forced us to purchase tile out of the terms of the contract, failed to order fixtures, a door and window, and not factored in significant costs for electrical, dryway, shower pans, and tile and fixture installation. Subsequent estimates to complete this work and our own sourcing for this project, indicate that the total cost of this project will exceed 15k with no significant upgrade to features or finishing, and with us personally completing additional demo, resetting HVAC location, and doing fixture installation.
Based on this experience, we are seeking the following compensation.
