Fusco Home Remodeling LLC, owned by Matthew Fusco, was contracted to build me a new rear deck 10x14 (140 sq ft) According to my receipt, it states, ‘This is a wheelchair accessible deck using pressure treated lumber and decking’. Materials were included in the price ‘’All pressure treated framing and lumber, decking materials, railings. Concrete, and anchors to construct a new elevated rear deck consisting (10x14) approximately 140 sq ft.” Cost $10,920.00. I gave Mr. Fusco a 40% down payment of $4368.00, ( which I found out later was above the HPIC of 20%) and he agreed to started in 3 weeks. 8 weeks later, he started, but, told me that he got a new job and so he had to leave. He came and went, first saying it would take 4-5 days, then next week. Meanwhile, he had removed the steps from my back door and refused to replace all the old decking where the wheelchair ramp was to go. After less than 24 hours of work by primarily someone other than him, as he seldom stayed, he tried to put his teenager to work on my property. I refused. He brought inferior wood. I said go to the lumber company and get it. I’ll pay the difference. But, He submitted a bill for partial payment and left. At the end of that day, his employee, had screwed five deck boards down so badly and they were so short that I began to question the foundation. I looked the information online at our municipal website and found the work to be incorrect. I emailed Mr Fusco telling him I was dissatisfied and wanted to square up. He refused. He sent me an unprofessional text ranting that I should contact his lawyer, which I did. I also contacted the building inspector. The building inspector added his input, which is not good. So after his atty ignored two voicemails, I filed with the AG’s office. His attorney didn’t respond with insurance information. Mr Fusco ran over a pipe and never fixed it, left deck debris, and left an unsafe area. He breached his own contract on safety. Now, I have to sue him. I’m a senior woman with disabilities. I can’t get out my back door safety. I can’t get to my backyard from the deck safety and neither can my one eyed senior dog.
