Dan Hinchman was engaged in January 2019 to remove an old existing deck, and construct a new deck. Contract price was $7,500. Contract was accepted the same day it was proposed. Terms were very basic and as follows:
$2,500 at start of project as existing deck is removed.
$2,500 when posts, beams, joists (sub structure) are complete and decking boards are attached.
$2,500 final payment due when deck, landings, stairs, and railings are complete, and final inspection has occurred.
Old deck removal began in June 2019. Old deck was removed and left on site. Mid way through the project quality concerns were identified. A meeting with an inspector was scheduled. Quality concerns were discussed. Mr Hinchman agreed to address all concerns. He addressed some concerns the following day and never returned.
We are now left with an old deck on the driveway and new deck frame. New partial deck does not adhere to all building codes, it is made from reused lumber, is different in size than agreed upon, it is without the necessary landing to accommodate the home owner. The home siding was removed and not replaced, leaving the house vulnerable to pests and bugs.
Dan Hinchman has demanded and received payment of $5,500 which is inconsistent with the contract. He stole purchased lumber from the home site. He claims stolen lumber was returned and credit back, yet no invoice reflects this. He demands additional payments and sends unprofessional emails insulting the individuals in our family.
Mr Hinchman is a predator. He is looking for opportunities to financially take advantage of the community. In this situation, he collected $5500 and took advantage of an old lady. When questioned by her family (in the presence of a building inspector) regarding the progress, he walked off of the job.
Mr Hinchman was questioned early in the project, in the presence of an inspector, as a courtesy to him. He is not a professional. He is not capable of fielding valid, professional concerns.
After the inspector meeting Mr Hinchman realized that his work was being watched. He realized that he would have standards of quality to adhere to. He realized that he does not have the time, experience, or money left in the budget to satisfactorily complete the project. As a result, he quit. Fortunately, he was not able to deplete any more cash from our family for his subpar work.
