Unreliable and unresponsive contractor.
My wife and I hired Wheeler Construction to renovate our newly purchased home in June. The project was supposed to be finished within 90 days so that we would move in by September. During that time, weeks would pass without work being completed on the home or David returning our phone calls or e-mails. Under our purchase and renovation mortgage, our bank would pay David incrementally as he finished work. During the 90 days of the contract, David requested and was paid on two occasions from our bank for the demo work and replacement of the roof he finished, which amounted to less than a quarter of the renovation that was supposed to be completed. Adding to our concerns of David's slow progress, the sub-contractor who replaced the roof called us demanding payment after David wrote the subcontractor a check that bounced. After a week of further phone calls from the subcontractor, David finally made appropriate payment to the subcontractor.
Due to David's continuous unfulfilled promises of imminent progress, we prepared a notice of termination. Before we delivered the termination, the October 4th flood made further renovation under the contract a moot point when it destroyed our home with water reaching the roof and leaving a layer of muck up to seven feet throughout the home. On October 6th, I notified David that we were terminating the contract and requested the return of our $4,500 deposit minus the small amount of work he had completed in the month since his last payment from the bank. David said he would send us the final statement within a few days. However, in the past three weeks, David has failed to provide us with the final statement or to return requests by phone, e-mail, and text message to return our deposit minus the small amount he is due.
Unfortunately, getting David to return our deposit has proved as frustrating as trying to get him to finish work under the contract was.
